This writ petition is filed under Article 226 of Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for records on the file of the 2nd respondent herein in Na.Ka.No. Pa2/ 2140/ 20- 22 dated 30.01.2024 and to quash the same and to direct the 1st respondent herein to restrain from indulging in any such anti association activities. Mr.C.Selvaraj, AGP in all the writ petitions COMMON ORDER These three writ petitions have been filed challenging the proceedings dated 30.01.2024 wherein the second respondent has sought for service particulars of the petitioner for initiating disciplinary proceedings.

It is the case of the respondents that the petitioners during a meeting held by the Tamil Nadu Forest Staff Association on 27.02.2022, they made derogatory statements made and also critisied by the directions issued the High Court in an earlier case. Since the action of the petitioners is in violation of Section 11 & 15 of Tamil Nadu Government Servants Conduct Rules 1973 and Rule 9(A) of Tamil Nadu Civil Services (Discipline and Appeal) Rules 1955, the second respondent issued the proceedings dated 30.01.2024 enclosing a proforma seeking service details of the petitioners. Challenging the same, the present writ petitions have been filed.

3. The second respondent has filed a detailed counter affidavit wherein it is clearly stated that the petitioners have not been issued with any charge memo

yet and only service particulars of the petitioners was sought for. Merely calling for service particulars of the Government servant cannot be the reason for the petitioner/Government servant to rush to the Court with present writ petitions. The second respondent, therefore, prayed that the writ petitions may be dismissed.

4. Heard both sides and perused the materials available on record.

5. The petitions are highly pre-mature in nature. As rightly pointed out by the second respondent, the petitioners have not yet been given a charge memo or any action has been taken against them. The second respondent has only sought for service particulars of the petitioners. The petitioners cannot have any grievance merely because their service particulars have been called for. The petitioners have rushed this Court by filing these writ petitions, which is highly premature. The 3rd respondent is directed to furnish the service particulars of the petitioners as sought for by the second respondent within a period of two weeks from the date of receipt of a copy of this order.

6. In the result, the writ petitions fail and the same are dismissed. No costs. Consequently, connected miscellaneous petitions are closed. 15-12-2025 Rli
