PRAYER: Civil Revision Petition filed under Section 115 of C.P.C, against 1/6

the fair order dated 06.10.2012 made in I.A.No.2385 of 2011 in I.A.No.1352 of 2009 in O.S.No.124 of 1987 on the file of the Court of the District Munsif, Udumalpet.

For Petitioner : Mr.T.Dhanasekaran For R1 : Mr.M.Guruprasad O R D E R This Civil Revision Petition is arising out of I.A.No.2385 of 2011 for appointment of Advocate Commissioner in the final decree proceedings in I.A.No.1352 of 2009 in partition suit O.S.No.124 of 1987.

2. The learned counsel for the respondents/defendants stated that the final decree proceedings have been completed and aggrieved by certain portion of the final decree, the parties has preferred regular appeal and the same was also disposed of. Aggrieved against the said decree and judgment of the First Appellate Court, they also preferred S.A.No.845 of 2018 and the same is pending before this Court. As this application is filed under Section 115 of C.P.C and in view of the 2/6

subsequent development in the matter, the C.R.P has become infructuous.

3. Accordingly, this Civil Revision Petition is dismissed as having become infructuous. No costs. Consequently, connected Miscellaneous Petition is closed.
