ORDER

The present writ petition has been filed challenging the order of the 2nd respondent dated 18.01.2024 and quash the same and to consequently direct the 2nd respondent to delete the name of the illegally wedded wife and include the petitioner and her children's name in the service register of the 3rd respondent.

2. The learned counsel appearing for the petitioner would submit that the petitioner married the 3rd respondent on 10.12.2002 and begotten two children. Thereafter, the 3rd respondent left the petitioner and performed second marriage, thereby, the petitioner filed a maintenance case on the file of the District Munsif cum Judicial Magistrate, Chengam for payment of monthly maintenance and the same was allowed on 12.02.2013. In the meanwhile, the 3rd respondent filed Divorce petition in F.C.O.P. No.30 of 2021 before the Family Court, Tiruvannamalai, the same is pending. Pending Divorce Petition, the petitioner submitted a representation before the respondents for including the petitioner's and her children's name in the Service Records of the 3rd respondent as a nominee, however, the same was rejected on the ground that the divorce petition filed in F.C.O.P. No.30 of 2021 is pending. Aggrieved by the same, the petitioner 2/6

has filed the present writ petition.

The learned counsel for the petitioner would further submit that at the time of filing an application to enter the petitioner's children as nominee of the 3rd respondent, the divorce petition filed by the 3rd respondent was pending and the same was dismissed for default and subsequently restored. However, it is the case of the petitioner that her request is only to include the names of her children in the service records of the 3rd respondent and not her name, the same was rejected and that the same is not a maintainable one. It is the further submission of the learned counsel for the petitioner that earlier the 3rd respondent had included the names of the petitioner and their children in the service records and thereafter due to family dispute, a revised nomination was filed and the same was entered in the service records.

It is stated that the revised nomination was made without issuing any notice to the petitioner, which is in violation of principles of natural justice. Accordingly, the learned counsel for the petitioner prays for appropriate orders to include the names of her children in the service records of the 3rd respondent.

4. The learned counsel for the 3rd respondent would submit that the 3rd respondent has no serious objections in including the names of the children as nominee in the service records.

In view of the above submission made by the learned counsel appearing for the 3rd respondent, there shall be a direction to the 2nd respondent to enter the names of the children of the petitioner and the 3rd respondent as nominee in the service records of the 3rd respondent, however, the claim of the petitioner is subject to the result of the original petition pending before the Trial Court.

6. Accordingly, the writ petition stands disposed of. No costs. Consequently, the connected miscellaneous petition is closed. 10.12.2025 Speaking (or) Non Speaking Order Index : Yes/ No mka 4/6
