O R D E R

This writ petition has been filed for direction to the first respondent to include the petitioner's name in the ensuing panel for promotion to the post of Assistant Executive Engineer. 2.

The case of the petitioner is that the petitioner had joined in the post of Junior Engineer in Rajiv Gandhi Government Hospital, Chennai. However, he was not included in the panel of promotion to the post of Assistant Executive Engineer.

On instruction, the learned Additional Government Pleader submitted that the petitioner now attained age of superannuation. Earlier, the petitioner had been served with three sets of charge memo's. In pursuant to one charge memo, he was punished with stoppage of increment for a period of two years with cumulative effect. One set of charges was pending against the petitioner. Therefore, he was not included in the panel for promotion to the post of Assistant Executive Engineer.

Therefore, the prayer sought for in this writ petition cannot be granted. Accordingly, this writ petition is dismissed. Consequently, connected miscellaneous petitions are closed. There shall be no order as to costs.
