No 457/5A to an extent of 41/2 cents, totally 1.7 Acres situated at Mallikundham Village, Mettur Taluk, Salem District based on his online application dated 06.11.2025 with help of the 3rd respondent Police. ORDER
This writ petition has been filed seeking for a direction to the respondents 1 and 2 to survey and demarcate the property, which according to the petitioner is owned by him, based on his online application dated 06.11.2025, within a time frame to be fixed by this Court.
2.The petitioner had submitted an online application on 06.11.2025 for the aforesaid purpose. Since the same has not been considered till date, the petitioner has filed this writ petition.
3.Mr.D.Ravichander, learned Special Government Pleader accepts notice on behalf of the respondents 1 & 2. Mr.Venkatatesa Perumal, learned Government Advocate (Crl.Side) accepts notice on behalf of the 3rd respondent. 4.Since no adverse orders are passed against the respondents 4 to 7, notice to the respondents 4 to 7 is dispensed with by this Court. 5.No prejudice will be caused to the respondents 1 and 2 if the said authorities are directed to survey and demarcate the boundaries of the petitioner's property, more fully described in the prayer to this writ petition, after hearing the objections if any from the neighbouring land owners as well as any other party as they deem fit. Accordingly, this writ petition is disposed of in the following manner:- (a) Before surveying the lands in question, the respondents 1 and 2 are directed to issue notice to the neighbouring land owners and also to any other party, if they deem fit to put on notice.
(b) After receiving objections if any and after
considering the same, the respondents 1 and 2 shall conduct survey and demarcate the boundaries of the property, more fully described in the prayer to this writ petition, on merits and in accordance with law, within a period of 12 weeks from the date of receipt of a copy of this order.
(c) If the need arises for police assistance and on a request made by the 2nd respondent, the 3rd respondent shall render police assistance for the effective implementation of this order.
