The petitioner who was arrested and remanded to judicial custody on 11.02.2024 for the offences under Sections 279 & 304(A) of IPC @ Sections 279 and 304(2) of IPC in Crime No.114 of 2024, on the file of the respondent Police, seeks bail.
2.The case of the prosecution is that the daughter of the defacto complainant who was aged 12 years was standing near a photo shop opposite to her house, when a Bolero four wheeler driven by this petitioner came in a rash and negligent manner and dashed against her. She was brought dead to the hospital.
3.It is stated that in the order of the learned Principal Sessions Judge, Villupuram, the petitioner, under the influence of alcohol and without driving license drove the vehicle.
4.The petitioner can never compensate the loss of causing of death of a young 12 years old girl.
5.Taking all the factors into consideration particularly that he had no driving license and was under the influence of alcohol and drove the vehicle, I am not inclined to grant bail to the petitioner. https://www.mhc.tn.gov.in/judis 1/2
