Rules read with Order VII Rule 1 of CPC, praying for judgment and decree on the following terms: a) Directing the defendant to pay the plaintiff a sum of Rs.94,57,135/- (Rupees Ninety Four Lakhs Fifty Seven Thousand One hundred and thirty five Only) together with interest @ 18% p.a from 23.01.2015 onwards till realization in full;

b) To pay the cost of the suit.

JUDGMENT

The learned counsel for the plaintiff submitted that the dispute between the parties has been settled out of Court and he has filed a Memo dated 03.10.2019 to that effect.

2. In the light of the above submission made by the learned counsel for the plaintiff, the Civil Suit is dismissed as settled out of Court. The Memo shall form part of the decree.
