CRIME NO.1158 OF 2021.

Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to (i) modify the condition 6(a) "The petitioner shall deposit a sum of Rs.3,00,000/- (Rupees Three Lakshs only) to the credit of CRIME No.1158 of 2021 before the Learned Judicial Magistrate No.II, Coimbatore, within a period of fifteen (15) days after lifting of lockdown or the commencement of the Courts normal functioning whichever is earlier and shall produce the said receipt before the Court below on such deposit being made, the Learned Judicial Magistrate No.II, Coimbatore, shall obtain an affidavit of undertaking from the defacto complainant stating that in the event of the petitioner succeeding the case, the amount of Rs.3,00,000/- deposited by the petitioner to the credit of CRIME No.

1158 of 2021 will be returned to the petitioner and after obtaining such affidavit of undertaking from the defacto complainant, shall disburse the said amount to the defacto complainant within a period of two weeks thereafter" imposed by this Hon`ble Court in Crl.O.P.No.25893/2021 dated 06.01.2022.[CRL.MP.NO.3500/2022] (ii) Extend the time to executing surety in Crl.O.P.No.25893 of 2021 dated 06.01.2022 and thus render justice. [CRL.MP.NO.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.M.N.BALAKRISHNAN, Advocate for the petitioner and of M/S.L.BASKARAN, Government Advocate (Crl.Side) on behalf of the Respondent the court made the following order:- This petition has been filed by the petitioner to modify the condition as imposed by this Court in Crl.O.P.No.25893 of 2021 dated 06.01.2022.

2. The learned Counsel for the petitioner submits that the petitioner being a unmarried lady and living with her brother, she was not able to mobilize the funds. Hence, he seeks modification. 3.Considering the above facts this Court is inclined to modify the condition to the effect that the petitioner shall deposit a sum of Rs.2,00,000/- instead of Rs.3,00,000/-. to the credit of Crime No.1158 of 2021 before the learned Judicial Magistrate-II, Coimbatore.

4. Except the above modification, the other conditions imposed by the Court in Crl.OP.No.25893 of 2021 vide order dated 06.01.2022, shall remain unaltered.

5. Time granted by this Court in the Order passed in Crl.OP.No.25893 of 2021 dated 06.01.2022 is extended by a period of two weeks from the date of receipt of a copy of this order for the purpose of complying the order.
