PRAYER:Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 1 to 6th respondents to provide three cents vacant land as per commenced the process of taking possession issuing in Na.Ka 1051/86/T dated 04.07.1986 by the 6th respondent in situate at Salem District, Omalur Taluk, U.Maramanagalam Village in land in Survey No.35/1 extent 1.21.0 hectare and consequently by this Hon'ble Court may be fixed the stipulate time. O R D E R

This Writ Petition has been filed to issue a Writ of Mandamus, directing the 1 to 6th respondents to provide three cents vacant land as per commenced the process of taking possession issuing in Na.Ka 1051/86/T dated 04.07.1986 by the 6th respondent, situated at Salem District, Omalur Taluk, U.Maramanagalam Village in land in Survey No.35/1 to an extent of 1.21.0 hectare and consequently by this Hon'ble Court may be fixed the stipulate time.

Mr.V.Veluchamy, learned Additional Government Pleader takes notice for the respondents 1 to 6. In view of the limited relief sought for in this petition, on the consent expressed by the Learned counsel appearing for either side, taken up for final disposal. Since, no adverse order is passed against the 7th respondent, notice on 7th respondent is dispensed with.

The case of the petitioners is that the property to an extent of 1.21.0 hectare comprised in Survey No.35/1, situated at Salem District, Omalur Taluk, U.Maramanagalam Village, belongs to Government and the said land is classified as Government Poromboke. In an earlier occasion, in order to provide free house site patta in favour of the petitioners and other similarly situated persons, they drawn the eligibility list for providing patta to the landless poor in which the petitioners names were found. However, the patta was not issued on the ground that a third party had filed a suit in O.S.No.477 of 1986 and the same was dismissed and even after the disposal

of the said suit by the Civil Court, the free house site pattas were not issued to the petitioners and other similarly situated persons.

The learned counsel for the petitioners submitted that as on date there is no legal impediment for issuance of free house site patta. Hence, this Court may issue a direction to the sixth respondent to consider the representation of the petitioners dated 08.02.2022 and may pass appropriate orders within the stipulated time as fixed by this Court.

5. The learned Additional Government Pleader appearing for the respondents, would submit that the representation made by the petitioners will be considered and appropriate orders will be passed on merits within the time frame to be fixed by this court.

In view of the aforesaid submissions, this Court without expressing any opinion on the merits of the case, directs the sixth respondent to consider the representation of the petitioners dated 08.02.2022 and after giving an opportunity of hearing to the petitioners and the 7th respondent herein and pass orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.

With the above directions, this writ petition stands disposed of. Consequently, connected Miscellaneous petition is closed. No costs.
