This writ petition has been filed seeking issuance of Writ of Mandamus directing the respondents waiver of the lease amount and to extend the fishery right lease period in respect of Kaveripakkam Lake located at Kaveripakkam Village, Ranipet District for period of 2 years based on the representation dated 11.11.2022 and as per G.O.Ms.No.332, Animal Husbandry and Fisheries Department, dated 17.11.1993.
2.The learned counsel appearing for the petitioner submitted that the petitioner obtained fishery right to lay and catch fishes in Kaveripakkam Lake located at Nemili Taluk, Ranipet District for a period of three years vide G.O.Ms.No.332, Animal Husbandry and Fisheries Department, dated 17.11.1993 from 01.07.2020 to 30.06.2023 and due to COVID - 19 pandemic and due to excess rain, the petitioner was not able to harvest the fish from the lake and hence 2/4
the petitioner made representation dated 11.11.2022 to the respondents 1 to 3 seeking to extend the lease period for a period of two years and waiver of the lease amount for the extension period, however, the said representation has not yet been considered. Hence, this Court may, without going into the merits of the case, issue direction to the second respondent to consider the petitioner's representation dated 11.11.2022 and to pass appropriate orders, within a reasonable time frame.
3.Considering the limited relief now sought for by the learned counsel appearing for the petitioner, this Court, without expressing any opinion on the merits of the case, directs the second respondent to consider the petitioner's representation dated 11.11.2022, on merits and in accordance with law and to pass appropriate orders, within a period of four weeks from the date of receipt of a copy of this order, if not already passed.
4.The writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
