The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 324(6), 118(1) and 351(2) of BNS, 2023 in Crime No.39 of 2026, on the file of the respondent Police, seeks anticipatory bail.
2. The allegation against the petitioner is that due to previous enmity with the defacto complainant, petitioner had dashed his car on the two wheeler in which, defacto complainant was traveling, due to which, defacto complainant sustained grievous injuries. Hence, the case.
3. The learned counsel for the petitioner submitted that due to previous enmity, false complaint has been lodged. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl. Side) reiterated the prosecution case and submitted that the petitioner has no previous cases and also submitted that the injured person is suffering grievous injuries. Hence, he opposed for grant of anticipatory bail to the petitioner. 2/4
5. Considering the nature of injuries sustained by the defacto complainant and it is a case of attempt to murder, this Court is not inclined to grant bail to the petitioner.
