A.No.1194 of 2021 A.No.1194 of 2021 C.V.KARTHIKEYAN J, In the affidavit filed in support of the present application, which is an application filed under clause 12 of the Letters Patent seeking leave to institute the suit within the jurisdiction of this Court, the proprietor of the plaintiff had stated that part of cause of action arose within Chennai where the defendant had approached the plaintiff to purchase the materials and from where the materials were also supplied to the defendants.

2. It is also stated that the sales, taxes and invoices have also been raised from Chennai and also payments have been made by the defendants to the Bank Accounts of the plaintiff at Chennai. However, it is seen from the description of cause title that the three defendants are residing outside the jurisdiction of this court.

3. In view of the fact, that a substantial part of the cause of action had arisen within the jurisdiction of this Court, leave to sue is granted. https://www.mhc.tn.gov.in/judis/ 1/2

4. Leave is also sought owing to the fact that the defendants are residing outside the jurisdiction of this Court.
