J U D G M E N T

(Delivered by S.M.SUBRAMANIAM, J.) This writ appeal has been instituted challenging the order dated 05.01.2022 passed in W.P.No.28372 of 2021.

2. Initially the land acquisition proceedings are initiated in the year 1976 and subsequently dropped by the Government. Thereafter, a fresh notification was issued under Section 15(2) of the Tamil Nadu Highways Act, 2001. It was published and by following the procedures, award has also been passed. Award enquiry notice issued to the appellant came to be challenged in the writ petition. The learned single Judge held that the award enquiry notice, which is under challenge after a lapse of about one year is not entertainable. That apart, the Writ Court found that there is no infirmity or irregularity in respect of the award enquiry notice issued under the provisions of the Tamil Nadu Highways Act. 2/4

3. That being the findings of the Writ Court, there is no acceptable ground raised by the appellant to interfere with the Writ Court order impugned. Consequently, the writ appeal is dismissed. No costs. Connected miscellaneous petition is closed.
