Respondents PRAYER:

Writ petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondents to pass orders on the representation dated 21.2.2017, requesting to absorb in the existing permanent vacancy in accordance with G.O.Ms.No.27, Finance Department, dated 24.1.2007 and grant regular scale of pay with all monetary benefits.

O R D E R

The grievance of the writ petitioner is that the Government issued G.O.Ms.No.27, Finance Department, dated 24.1.2007 in respect of the State Public Sector Undertakings/Co-operative Institutions and the methods deputed to other State Public Sector Undertakings or appointed on contract in Governmental Departments prior to the issue of orders on the closure of the parent Undertakings/Co-operative Institutions and the terms and conditions for absorption are also prescribed in the Government Order. Though the writ petitioner is eligible to avail the benefit of the Government Order, the same has not been considered in spite of the fact that the writ petitioner has submitted a representation to the respondents on 21.2.2017.

In this view of the matter and without going into the merits of the matter, the second respondent is directed to consider the representation submitted by the writ petitioner on 21.2.2017 and pass orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.

3. Accordingly, the writ petition stands disposed of. However, there shall be no order as to costs.
