Crl.M.P.No.3115 of 2022 in Crl.A.SR.No.10229 of 2022 D.BHARATHA CHAKRAVARTHY, J., This petition has been filed to condone the delay of 29 days in filing appeal as against the order of acquittal passed in C.C.No.240 of 2017, dated 17.12.2019 on the file of the Judicial Magistrate, Fast Track Court, Alandur.

2. In this case, it is seen from the proof affidavit of service that the intimation of the registered letter has been duly delivered. However, the respondent has not claimed the notice.

3.The learned Counsel for the petitioner would submit that the learned Counsel appearing before the Trial Court also had received the notice.

4.In that view of the same, I hold that the service is complete.

5.Having satisfied with the reasons stated in the affidavit filed in support of the petition, the delay of 29 days in filing the appeal in Crl.A.SR.No.10229 of 2022 is condoned.

6.Registry is directed to number the Crl.A.SR.No.10229 of 2022, if it is otherwise in order.
