The petitions are filed for setting aside the abatement caused by the death of the 1st respondent and to bring on record the 4th respondent as the legal heir of the deceased 1st respondent.

2. Notice was sent to the 4th respondent and the same was returned as "refused". The name of the 4th respondent is printed in the cause list and none appears for him.

3. I have gone through the affidavit filed in support of the petitioner and I am satisfied with the reasons stated therein, hence, the applications are allowed.

4. Registry is directed to carryout necessary amendments in the cause title.
