ORDER
The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 303(2), 326(a), of BNS Act r/w. 21(1) of the Mines and Minerals (Development & Regulation) Act, 1/4
1957, in Crime No. 3 of 2026, seeks anticipatory bail.
2. The allegation against the petitioner is that the petitioner along with other accused were found in illegal transportation of 120 kgs of river sand in 2 bags without valid permit. Hence, the complaint.
3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prayed for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that, petitioner has no previous cases.
5. Heard the learned counsels on either side and perused the materials available on record.
6. Considering the gravity of the offence committed by the petitioner and he is involved in damaging ecology by illegal quarrying in the water body and the quantity involved in this case is very high, this Court is not inclined to grant anticipatory bail to the petitioner.
7. Accordingly, this Criminal Original petition is dismissed. 17.02.2026 smn 2/4
