This application has been filed by the plaintiff/applicant seeking leave on the ground that the respondent is residing outside the territorial jurisdiction of this Court.
2. The learned counsel appearing for the applicant submits that the transaction was made at Chennai and in pursuance of the same, the goods were transported from Chennai. Hence, territorial jurisdiction is available to this Court. In support of the same, the learned counsel appearing for the applicant has made a reliance on the Judgment of the Patna High Court, in the case of Shreenath Singh and Bishwanath Agrawal vs. H.K.Banerjee, reported in 1979 AIR (Patna) 146.
3. Considering the submissions made by the learned counsel for the applicant and taking note of the averments made in the plaint, leave is granted.
