This petition has been filed to modify the condition imposed on the petitioners are directed to deposit a sum of Rs.2,00,000/- (Rupees two lakhs only) to the credit of Crime No. 12 of 2023 before the concerned Magistrate within a period of fifteen days in the above Crl.O.P.No.1609 of 2023 dated 06.02.2023.

2. The learned counsel for the petitioners submitted that though the 1st petitioner already paid the entire amount of Rs.5,00,000/- to the defacto complainant, the same was claimed herein. He would also submit that having paid the entire sum of Rs.5,00,000/- to him, he is not able to pay further amount as directed by this court. Hence, the present petition has been filed to modify the condition.

3. Considering the facts and circumstances and also considering the reasons stated by the petitioner in the petition seems to 1/3

be justifiable, this Court is inclined to modify the condition that the petitioner shall deposit the sum of Rs.1,00,000/- (Rupees one lakh only) to the credit of Crime No.12 of 2023 before the concerned Magistrate within a period of two weeks from the date of receipt of copy of this order.

4. Except the above modification, the other conditions imposed by this Court in Crl.O.P. No. 1609 of 2023 vide order dated 06.02.2023 shall remain unalterted.

5. Time is extended for further period of two weeks for execution of sureties from the date of receipt of copy of this order. 17.03.2023 rpp 2/3
