PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus calling for the records of the respondent in connection with the impugned orders passed by him in RC.No.200508/NGBIII (2)/2009 dated 08.07.2010 and quash the same and further direct the respondents to revise the seniority of the petitioner as Grade-I PC by taking into consideration the total service rendered by him and grant him further promotion as Head Constable and Sub-Inspector of Police with all consequential service and monetary benefits.

ORDER

With the consent of both the parties, this writ petition is taken up for final disposal.

2. The petitioner's request, for being promoted as a Grade-I Police Constable under junior promotion, was rejected through the impugned order dated 08.07.2010, stating that the petitioner's educational qualification was only 8th Standard and therefore was eligible for consideration for promotion as GradeI Police Constable under senior promotion, after completion of 10 years of service as Grade-II Police Constable.

3. For the purpose of junior promotion, the approved probationers ought to have completed S.S.L.C. qualification and since the petitioner herein did not have the required https://hcservices.ecourts.gov.in/hcservices/

qualification, his request for being promoted as a Grade-I Police Constable under junior promotion, has been rejected. I do not find any infirmity in such a reasoning given by the respondent in the impugned order.

At this juncture, the learned Senior Counsel appearing for the petitioner submitted that, in view of the decision of the Hon'ble Full Bench of this Court, he would be entitled for consideration of the total service of more than 25 years for service and monetary benefits and therefore, seeks for liberty to make a representation in this regard.

5. In the light of such a submission, the petitioner herein is granted liberty to make such a claim before the respondent herein and on receipt of the same, the respondent shall consider such a request, in accordance with law and pass appropriate orders, as expeditiously as possible.

6. With the above liberty, the Writ Petition stands dismissed. No costs.
