ORDER

The petitioner, who was arrested and remanded to judicial custody on 07.01.2026 for the alleged offence under Sections 137(2) of BNS and under Sections 3(d) r/w 4(2), 5(m) r/w 6(1), 9(m) r/w 10 of POCSO Act, in Crime No.03 of 2026 on the file of the respondent police, seeks bail. 2.The allegation against the petitioner is that the petitioner is ranked as A1. The victim is a girl child aged about 7 years. It is alleged that, taking

advantage of the minor girl, the petitioner committed aggravated penetrative sexual assault, which resulted in grievous injuries to the victim. Similarly, other accused also committed such offence and the same was reported to the family members and subsequently, a case has been registered.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person, he has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4.The learned Government Advocate (Crl.Side) for the respondent police reiterated the prosecution case and submitted that the statement of the victim girl reveals that the petitioner has committed penetrative sexual assault and also caused injuries to the victim. Hence, he opposed for the grant of bail to the petitioner.

5.I have also gone through the statement of the victim girl, in which she narrates various disturbing facts including the manner in which she was subjected to sexual assault. Considering the fact that the investigation in this case is pending and the petitioner was arrested only very recently, this Court is
