This Criminal Miscellaneous petition has been filed to implead the proposed respondent as the 5th respondent in the Criminal Original petition, is ordered.

The grievance of the impleading petitioner is that after the final orders were passed in the Criminal Original petition, a review petition has been filed and the same is pending before this Court and in the strength of the order passed by this Court, the petitioner is trying to take possession of the property.

This Court did not go into the issue of possession in the order passed in the main Criminal original petition and this Court had only directed police protection to the Revenue Officials to conduct the survey and no further orders have been passed in the main Criminal Original petition. Insofar as the right and possession of the property is concerned, the parties will have to agitate the same only in the pending review petition and this Court will not have any say in that regard, in exercise of its jurisdiction under Section 482 of Cr.PC. 5.
This Criminal Miscellaneous petition is disposed of accordingly.
