This Criminal Original Petition has been filed seeking to enlarge the petitioner on bail in S.C.No.76 of 2020 on the file of the II Additional Sessions Judge, Chennai, in connection with the Crime No.47 of 2018, on the file of the respondent Police.

2. Learned counsel for the petitioner submitted that this is the second bail application of this petitioner before this Court and this Court, had dismissed the earlier bail application filed by the petitioner in Crl.O.P.No.1097 of 2023 vide order dated 27.01.2023. He further submitted that the petitioner was constrained to file a petition before the Hon'ble Division Bench of this Court in H.C.P.No.1492 of 2022 and this Court, by an order dated 13.02.2023, pleased to set the petitioner at liberty forthwith, unless required in connection with any other cases. Therefore, he prays for grant of bail to the petitioner.

Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that this is the second bail application of the petitioner and the earlier bail application was dismissed by this Court vide order dated 27.01.2023, with a direction to the learned trial Court to complete the trial and dispose the case within a period of four months from the date of receipt of a copy of that order. He further stated that the trial in respect of this case and in all other pending cases against him are in progress. Therefore, if the bail is granted to the petitioner at this stage, there is every possibility for him to abscond again and thereby, it would derail the progress of the trial. Hence, he vehemently opposed to grant bail to the petitioner.

4. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondent and perused the entire materials available on record.

5. Taking into consideration the facts and circumstances of the case, the submissions made by the learned Government Advocate (Crl.Side) and

also considering the fact that trial is in progress, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this Criminal Original Petition stands dismissed. 02.03.2023 ham
