O R D E R

This Writ Petition has been filed to direct the respondent to register the judgment and decree dated 17.08.2023 passed in O.S.No.302 of 2017 on the file

of the District Munsif Court, Sulur, Coimbatore District. 2.The petitioner had presented the above referred judgment and decree dated 17.08.2023 with the respondent for registration on 20.01.2026. However, according to the petitioner, till date, the judgment and decree dated 17.08.2023 referred to supra, has not been registered by the respondent. Only under those circumstances, the petitioner has filed this Writ Petition. 3.Mr.Jayachandran, learned Government Advocate, accepts notice on behalf of the respondent.

4.When the matter was taken up for hearing today, Mr.S.Kumaresan, learned counsel intervened and submitted that he is representing the plaintiff in the suit in O.S.No.302 of 2017. The learned counsel for the plaintiff in O.S.No.302 of 2017 has raised objection for the registration of the judgment and decree dated 17.08.2023 submitted by the petitioner for registration before the respondent on 20.01.2026.

5.The plaintiff in O.S.No.302 of 2017 has not been arrayed as a party respondent in this Writ Petition. Since the plaintiff in O.S.No.302 of 2017 has raised objections with regard to registration of the judgment and decree dated 17.08.2023, passed in O.S.No.302 of 2017, presented by the petitioner for

registration, necessarily, the plaintiff in O.S.No.302 of 2017 will have to be heard by the respondent by putting him on notice whenever the petitioner, who is the defendant in O.S.No.302 of 2017 presents the judgment and decree dated 17.08.2023 passed in O.S.No.302 of 2017, for registration. This Court is not expressing any opinion on the merits of the respective contentions. 6.For the foregoing reasons, this Writ Petition is disposed of by directing the respondent to issue notice to the plaintiff in O.S.No.302 of 2017 on the file of the District Munsif Court, Sulur, Coimbatore District, calling upon the plaintiff in O.S.No.302 of 2017 to submit his objections if any, with regard to the request made by the petitioner in this Writ Petition, for registration of the judgment and decree dated 17.08.

2023 and on receipt of the said objections, the respondent shall take a final decision as to whether the judgment and decree dated 17.08.2023 passed in O.S.No.302 of 2017 on the file of the District Munsif Court, Sulur, Coimbatore District, can be registered or not. The respondent is directed to complete the aforesaid exercise within a period of eight weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
