Respondents Writ Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus directing the respondents 1 and 2 to take decision with regard to the 5th respondent community certificate and send report to the District Collector, Erode for enabling him to take necessary steps for removal of the 5th respondent from the post of President of Ammapet Town Panchayat, Ammapet, Erode District.

ORDER

AGNIHOTRI,J.,) This writ petition is filed seeking to issue a direction to the respondents 1 and 2 to take a decision with regard to the 5th respondent's community certificate and send a report to the District Collector, Erode for enabling him to take necessary steps for removal of the 5th respondent from the post of President of Ammapet Town Panchayat, Ammapet, Erode District.

2. The third respondent, in his affidavit dated 07.01.2015, has clearly averred that the community certificate issued in favour of the fifth respondent has been referred to the State Level Scrutiny Committee by his letter dated 12.06.2015 for verification and as such, this writ petition has become infructuous. A copy of the said communication is also produced before this Court and the same is recorded.

3. In view of the above, nothing survives for adjudication in this writ petition. Accordingly, this writ petition is disposed of . Consequently, M.P. No. 1 of 2015 is closed. No costs. Sd/- Assistant Registrar //True Copy// Sub Assistant Registrar ra.
