Respondent PRAYER : Petition filed under Section 11 of the Contempt of Courts Act, to punish the respondent herein for her act of willful disobedience to the order of this Court dated 12.10.2020 made in W.P.No.14456 of 2020. ORDER
The present contempt petition was filed before this Court on the ground that the order passed in W.P.No.14456 of 2020, dated 12.10.2020 was not complied with by the respondent.
2.When the matter was taken up for hearing on 08.04.2022, this Court passed the following order:
Mrs.P.Revathi, Sub Inspector of Survey, was present at the time of hearing.
2. When the matter was taken up for hearing, the learned Additional Government Pleader submitted the proceedings of the Tahsildhar, Thiruppur, along with the sketch. The learned counsel for the petitioner submitted that this sketch has been prepared even without calling the petitioner at the time of inspection. The learned counsel for the petitioner raised serious objections.
3. Post this case on 22.04.2022. The objections raised by the petitioner can be given in the form of affidavit in order to understand the real problem.
3.When the matter was taken up for hearing today, Ms.P.Revathy, Taluk Deputy Surveyor, Tirupur South, Tirupur, was present and a report was also submitted before this Court. In the said report, various steps taken by the respondent pursuant to the orders passed by this Court and the objections raised by the rival parties have also been mentioned. There is also a mention about a suit that was filed by one of the parties before the Civil Court.
4.In the considered view of this Court, whatever decision is taken by the respondent on the application made by the petitioner, can be
conveyed to the petitioner and the other rival claimants by way of order or proceedings. Whoever is aggrieved by the same, can workout their remedy in the manner known to law.
5.In view of the report submitted by the respondent, no further orders can be passed in this contempt petition and there shall be a direction to the respondent to issue an order/proceedings to the petitioner and the other rival claimants on the application made by the petitioner for survey, within a period of two weeks from the date of receipt of copy of this Order.
