JUDGMENT

When the matter is taken up for hearing, the learned counsel appearing for the appellant submitted that both the defendants/respondents died and that the learned counsel for the appellant is unable to find out the particulars regarding the legal heirs of the deceased defendants/respondents and prayed that the Second Appeal may be dismissed as abated.

2. Recording the said submission made by the learned counsel for the appellant, the Second Appeal is dismissed for default for not bringing the legal heirs of the deceased defendants/respondents. No costs. Consequently, connected Miscellaneous Petition is closed.
