Petition under Article 226 of the Constitution of India praying for issue of a Writ of Mandamus directing the 3rd respondent to return all the remaining testimonials/certificates of the petitioner including Transfer Certificate and Conduct Certificate relating to the petitioner's BDS Degree course within the time to be stipulated by this Honourable court and consequently direct respondents 1 and 2 to extend time as this Honourable Court deem fit for production of Transfer Certificate and Conduct Certificate relating to the petitioner's BDS degree course of the petitioner.

O R D E R

The petitioner was admitted in BDS course in the 3rd respondent College from 2007-2013. Though the petitioner completed the course, the 3rd respondent did not issue Graduation Certificate and other original certificates and insisted upon the petitioner to pay more than Rs.1 lakh. The purpose of getting the certificates is to enable the petitioner to join Law Degree namely, three year LLB course in the 1st respondent University for the academic year 2017-2018 and the petitioner was already called for counselling by the 1st respondent on 06.11.2017. The provisional allotment letter was also given to the petitioner. Therefore, the petitioner has approached this Court seeking a Mandamus directing the 3rd respondent to return all the remaining testimonials/certificates of the petitioner including Transfer Certificate and Conduct Certificate relating to the petitioner's BDS Degree course within a stipulated time and for a further direction to respondents 1 and 2 to extend the time to enable the petitioner to produce the certificates and join LLB course.

When the matter is called today, Mr.Abhishek, learned counsel for the 3rd respondent handed over all the original certificates to be given to the petitioner in Open Court and the same was received by Mr.S.D. Venkateswaran, learned counsel for the petitioner. In view of that, the first limb of the order is complied with.

Mr.V. Vasanthakumar learned counsel for the 1st respondent and Mr.T.M. Pappiah, learned Special Government Pleader for the 2nd respondent would submit that since the petitioner has got all the certificates, he could join the Law College on or before 06.12.2017. Accordingly, time is extended to the petitioner to join the 2nd respondent Law College before 06.12.2017.

It is submitted by Mr.Abhishek, learned counsel for the 3rd respondent that a sum of Rs.1,92,000/- is still due from the petitioner. If at all, any amount is due from the petitioner, it is always open to the 3rd respondent to proceed against the petitioner to recover the amount.
