VELMURUGAN CRIMINAL MISCELLANEOUS PETITION No.2823 of 2019 IN CRL A.112/2019 VELMURUGAN [ PETITIONER ] Vs THE STATE REP BY ITS, [ RESPONDENT ] THE INSPECTOR OF POLICE, J-5 SHASTRI NAGAR POLICE STATION, BESANT NAGAR, CHENNAI- 600 090.

Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in CRL.A.No.112 of 2019 on the file of the High Court,the High court will be pleased to suspend the sentence of rigorous imprisonment for 5 years imposed on the petitioner and to pay a fine of Rs.1000/- and in default of payment of fine, to undergo rigorous imprisonment for months imposed on the petitioner/appellant by the judgment dated 18.02.2019 in sessions case No.197 of 2017 by the principal sessions court,Chennai, for the offences U/s.304 r/w 34 of IPC and to enlarge the petitioner on bail pending disposal of the above criminal Appeal and pass such further or the orders.

Order : This petition coming on for orders upon perusing the petition and the Memorandum of Grounds in CRL.A.No.112 of 2019 on the file of the High Court and upon hearing the arguments of M/S.T.SAI KRISHNAN Advocate for the petitioner and of MR.R.RAVICHANDRAN Government Advocate on behalf of the Respondent, the court made the following order:- The learned counsel for the appellant seeks permission of this Court to withdraw the Criminal Miscellaneous Petition and he has also made an endorsement to that effect.

2. In view of the submission and endorsement made by the learned counsel for the appellant, the criminal miscellaneous petition is dismissed as withdrawn.
