Public Prosecutor COMMON ORDER Crl.O.P.No.7675 of 2022 has been filed to set aside the order dated 25.02.2022 made in Crl.M.P.No.261 of 2022 in C.C.No.6 of 2020 on the file of the Special Court for TNPID Act, Chennai.

2. Crl.O.P.No.7682 of 2022 has been filed to set aside the order dated 25.02.2022 made in Crl.M.P.No.262 of 2022 in C.C.No.6 of 2020 on the file of the Special Court for TNPID Act, Chennai.

3. Both the matters were listed 'for admission' on 04.04.2022 and at the request of the learned counsel for the petitioner, it was adjourned to one week. Thereafter, the petitioner did not take any steps to list the matter 'for admission'. When, the matter was taken up for hearing today i.e., 13.09.2022, there is no representation on behalf of the petitioners. 3/6

That apart, the Hon'ble Supreme Court of India, by an order dated 11.03.2022 in Miscellaneous Application Diary No. 30938 of 2021, has already directed the Trial Court to proceed with the trial in C.C.No.6 of 2022 on day to day basis not more than within a period six months from the date of receipt of a copy of the order. Even then, the petitioner failed to cross-examine the prosecution witnesses and filed a petition to defer cross-examination of LWs. 1 to 5, 7 & 8 and it was dismissed by the Trial Court. It is nothing but delay in tactics and as such, the Court below rightly dismissed the petition filed by the petitioner.

5. In view of the above, this Court finds no infirmity or illegality in the order passed by the Court below. Accordingly, these Criminal Original Petitions are dismissed.
