Respondents PRAYER: The Writ Petition is filed under Article 226 of the Constitution of India for the issuance of a Writ of Mandamus directing the respondents 1 and 2 to offer police protection of the petitioner's life and limbs and his house site property in Survey No.179/9, measuring an extent of 1745 1/4 sq.ft in Patta No.86 at Kanchipadi Village, Tiruttani Taluk, Tiruvallur District, pursuant to the petitioner's representation dated 13.01.2025 and interim injunction granted in favour of the petitioner against the third respondent in I.A.No.2 of 2024 in O.S.No.11 of 2024 pending on the file of the District Munsif Court at Tiruttani within a time frame that may be fixed by this Court.

ORDER

The Writ Petition has been filed to direct respondents 1 and 2 to provide police protection of the petitioner's life and limbs and his house site property in Survey No.179/9, measuring an extent of 1745 1/4 sq.ft in Patta No.86 at Kanchipadi Village, Tiruttani Taluk, Tiruvallur District.

2. It is seen that the petitioner owned the property. While so, the third respondent disturbed the peaceful possession of the petitioner. Hence, the petitioner filed a suit for permanent injunction in O.S.No.11 of 2024 on the file of the District Munsif at Tiruttani and obtained an interim order. Even then, the third respondent interfered with the peaceful possession and enjoyment of the subject matter of the petitioner.

3. The petitioner can very well approach the Civil Court for appropriate relief as against the third respondent for violation of the

interim order. Hence, the present Writ Petition filed for providing police protection cannot be considered. Therefore, the Writ Petition is dismissed. There shall be no order as to costs. 20.02.2025 asi To
