Respondents Petition is filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus by directing the respondents to sanction one set of incentive increment for possession of M.A.qualification to the petitioner by extending the benefits of the G.O.Ms.No.1024 Education Science and Technology Department dated 09.12.1993 with arrears of pay and allowance and with all other consequential benefits. With consent, the main writ petition itself is taken up for final disposal at the admission stage.
2. The petitioner was recruited through Teachers Recruitment Board and appointed as Special Teacher in Government Higher Secondary School, Nanganallur, Kancheepuram District on 24.11.2012. However, his services were regularised from 24.11.2012. Moreover, he had completed his probation period
and his probation also was declared by the respondents with effect from 24.11.2014. As the petitioner had acquired B.A., B.Ed., qualification, one set of incentive for passing higher qualification was sanctioned to him, in the year 2014, as per Government Order. Subsequently, petitioner has also has acquired M.A.Degree in May 2016, after seeking prior permission from the competent authority. After acquiring the Higher qualification, M.A Degree, the petitioner has made a representation seeking one more incentive increment, the same has not been considered. Hence this Writ Petition.
3. Mr.P.Sanjay Gandhi, learned Additional Government Pleader, takes notice for the respondents and seeks four weeks time to consider the representation of the petitioner on merits. 4.Considering the limited relief sought for in this petition and without going into the merits of the matter, this Court hereby directs the respondents to consider the representation made by the petitioner and pass appropriate orders, on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.
5. With the above direction, the writ petition is disposed of accordingly. No costs.
