Vs 1 J.ISMAIL [ RESPONDENTS ] 2 J.HAFEEZ 3 J.DAWOOD 4 G.PONNUMA 5 MEHARUNNISA 6 ZAIBOON BI 7 S.RAHIMAN BAIG 8 MALLIKA 9 FARIDA 10 DASTHAGHIR 11 HABEEB Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to condone the delay of 757 days in paying the Deficit Court Fee Rs.4,250/- in the above Appeal against the order made in OS.No.5 of 2015, on the file of the Additional District Judge (Fast Track Court), Villupuram, vide order dated 17.09.2019 [IN C.M.P.No.6811 of 2022 in A.S.(SR).No.149279 of 2019] Order : This Miscellaneous petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.J.AGNI SELVARAJU, Advocate for the petitioner, the court made the following order:- (Order of the Court made by M.DURAISWAMY, J.) There is a delay of 757 days in paying the deficit Court fee of Rs.4,250/-.
2.Though, the petitioners have satisfactorily explained the reasons for the delay in the affidavit filed in support of the petition, since the delay is on the higher side, the same can be condoned on payment of costs. Accordingly, the delay of 757 days in paying the deficit Court fee is condoned on condition the petitioners paying a sum of Rs.1,000/- (Rupees one thousand only) to the Hon'ble Chief Justice Relief Fund, within one week from the date of receipt of a copy of this order, failing which, it is made clear that the petition shall stand dismissed automatically without any further reference to this Court.
The petition is ordered.
