This Civil Revision Petition has been filed against the dismissal of the application filed under Order 7 Rule 11 and Section 151 C.P.C., rejecting of plaint.

2. It is stated by the learned counsel appearing for the revision petitioner that the substantial portion of the evidence is already over and the suit in O.S.No.1026 of 2010 itself is posted for defendant's evidence and they have also raised the issues raised in the suit.

3. In view of the same, all the issues can be raised in the suit itself. Hence the Civil Revision Petition is dismissed as infructuous and the learned III Additional Subordinate Judge, Coimbatore is directed to dispose of the suit within a period of four months from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petition is closed.
