PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus, calling for the entire records connected with the order of rejection in Memo.No. 011338/0145/Adm.II(4)/2008 dated 26.03.2008 passed by the 2nd respondent, quash the same and consequently direct the respondents to declare second Saturday as holiday as far as the petitioner is concerned. ORDER
With the consent of both the parties, this writ petition is taken up for final disposal.
2. The petitioner's request for availing holiday on 08.07.2000, as being a second Saturday, was rejected through the impugned order dated 26.03.2008. By placing reliance on the information received from the first respondent under the Right to Information Act, the petitioner seeks for a consequential prayer to declare second Saturday as an holiday.
3. The learned Standing Counsel for the respondents https://hcservices.ecourts.gov.in/hcservices/
submitted that the second Saturdays for Mettur Thermal Power Station are declared as holidays, insofar as the clerical staff are concerned and not for the technical assistants, like the petitioner herein. The information provided by TANGEDCO is for general employees of TANGEDCO and hence, the information provided by the first respondent under the Right to Information Act will not govern the second respondent-Mettur Thermal Power Station.
4. Since the second Saturday, i.e. 08.07.2000 was not a declared holiday in Mettur Thermal Power Station, the petitioner's request in this regard has been rightly rejected, through the impugned order dated 26.03.2008. As such, I do not find any infirmity in the impugned order and accordingly, the Writ Petition stands dismissed. No costs.
