C.M.P.Nos.4685, 4694 & 4695 of 2025 in S.A.No.1616 of 2011 C.V.KARTHIKEYAN, J.

These three petitions have been filed consequent to the death of the second respondent, R.M. Ponnusamy to condone the delay of 2419 days in filing the petition seeking to set aside the abatement, to set aside the abatement and to bring on record the legal representatives of the second respondent in the above second appeal. 2.The wife of the second respondent is Ponmani and she had participated in the mediation process held on 21.08.2025 and 03.09.2025 and had entered into an agreement with the appellants herein. The agreement had been reduced in writing on 03.09.2025 and a report from the Mediation and Conciliation Centre had been forwarded to this Court.

3.In view of that particular development, all these three petitions are allowed. Registry to record the death of the second respondent and bring on record his legal representatives as further respondents in the second appeal. 4.List the second appeal under the caption 'mediation settled cases' on 19.12.2025.
