S.Sivanarul Selvam v. Employees State Insurance
C.M.P.No.344 of 2018 in C.M.A.No.SR1009 of 2018 T.RAJA, J.
This civil miscellaneous petition has been filed seeking an order to condone the delay of 245 days in filing the appeal, on the ground that the petitioner, being a business personality, after the order was passed by the ESI Court, Cuddalore in E.S.I.C.O.P.No.2 of 2003, has been busily travelling to every place and he was unable to concentrate in the filing of appeal against the impugned order. Therefore, there has been a huge delay of 245 days in filing the present appeal.
2. If every businessman coming to this Court takes a plea that he was busy with the business and hence not able to attend to his personal case, this Court is not meant for entertaining any such irresponsible explanation for condoning the delay. As this Court finds no sufficient cause to condone the huge and unexplained delay of 245 days, the C.M.P.No.344 of 2018 stands dismissed. 26.06.2019 ss http://www.judis.nic.in
