O R D E R

This Criminal Original Petition has been filed praying to direct the respondent-Police to execute the bailable warrant dated 15.03.2016 issued against the accused by the VIII Metropolitan Magistrate, George Town, Chennai.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor for the respondent.

3. It is seen that this petitioner is the complainant in C.C.No.1197 of 2015 before the VIII Metropolitan Magistrate Court, George Town, Chennai, which has been launched against one K.Rajesh, for the offence under Section 138 of the Negotiable Instruments Act. The learned VIII Metropolitan Magistrate, George Town, Chennai, has issued bailable warrant for securing the presence of Rajesh. Alleging that the police are not executing the warrant, the petitioner is before this Court for a direction under Section 482 Cr.P.C.,

4. The learned Additional Public Prosecutor produced a https://hcservices.ecourts.gov.in/hcservices/

communication dated 20.05.2016 issued by the learned VIII Metropolitan Magistrate, George Town, Chennai, to the respondent-police stating that the warrant issued has been recalled, since the accused had surrendered.
