Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, calling for the entire records relating to the impugned order dated 04.12.2023 in proceeding Na.Ka.No.5021/2023/Pa2 on the file of the first respondent herein and quash the same and direct the first respondent to decide the condone delay petition filed along with revision dated 08.11.2023 and pass orders on merits. ORDER
This Writ Petition has been filed challenging the impugned order dated 04.12.2023 in Proceeding Na.Ka.No.5021/2023/Pa2 passed by the first respondent, thereby rejected the revision filed by the petitioner under Section 153 of the Tamil Nadu Co-operative Societies Act on the ground that the revision filed belatedly.
2. Heard the learned counsel appearing on either side and perused the materials available on record.
3. Though the petitioner approached the first respondent belatedly because of his poverty, he is also facing surcharge proceedings and criminal case. That apart, as against the order of dismissal, the petitioner may be given one more opportunity to agitate the appeal before the Revisional Authority.
4. Considering the above, the first respondent is directed to entertain the revision and pass orders on merits and in accordance with law. The petitioner is directed to file revision before the first respondent within a 2/4
period of one week from today, i.e., 28.02.2024.
5. With the above direction, this Writ Petition stands disposed of. No costs.
