The present miscellaneous petition has been filed seeking to condone the delay of 15 days in filing the above said criminal appeal against the judgment of acquittal passed in S.T.C.No.455 of 2021 dated 28.11.2023 on the file of the Judicial Magistrate No.I, Court (FAC), Namakkal.

2. Though notice was served and name of the respondent was printed in the cause list, he has not entered appearance either in person or through counsel.

3. Having satisfied with the reasons stated in the accompanying affidavit filed in support of this petition, this petition stands allowed.

4. Registry is directed to number the Criminal Appeal, if the papers are otherwise in order and list the same for admission.
