ORDER

This writ petition has been filed to direct the 1st respondent to consider the petitioner representation dated 05.12.2022 conduct the enquiry and cancel the sale deed Document No. 7404/2010.

2. Today, there is no representation on behalf of the petitioner.

3. The learned counsel appearing for the respondent would submit that the representation was made for cancellation of sale deed, registered in Doc.No.7404 of 2010, by invoking the power available to them under Section 77A of the Registration Act, 1908.

4. However, the validity of Sections 77A and 68(2) of the Registration Act, 1908, was struck down by the Hon'ble Division Bench of this Court vide order dated 02.08.2024 in W.P.No.10291 of 2022. In such case, the petitioner's representation, for cancellation of fraudulent sale deed, cannot be entertained by the respondents. Hence, he would contend that the said aspect may be the reason for non-appearance of the petitioner and prays for dismissal of this petition.

5. Therefore, considering the long pendency of this case and by recording the submission made by the respondent, this Court is inclined to dismiss this petition. Accordingly, this writ petition is dismissed for non-prosecution. No cost.
