JUDGMENT
When the matter is taken up for hearing today, the learned counsel for the appellant submitted that, without prejudice to its contention that it had 1/4
taken in the appeal, it still chose to opt for peace and settle the dispute amicably with the other side. A joint memo dated 03.11.2023 is also filed to that effect.
2.The joint memo is hereby recorded. This Court is informed that, by inadvertence, the respondent's name is typed as 'S.Palani' in the cause title to the appeal memorandum, whereas his name is 'R.Palani'. This Court now requires the Registry to correct the initial of the respondent as 'R.Palani' in the cause title.
3.The appellant is entitled to withdraw a sum of Rs.3,40,910/-. 4.This Civil Miscellaneous Appeal stands closed accordingly. No costs.
