ORDER
This writ petition has been filed challenging the impugned proceedings of the respondent dated 29.08.2023, 12.09.2023 and 20.09.2023, and for a consequential direction to the respondent to issue a legal heirship certificate to the petitioner.
2. Heard Mr.E.Vijayakumar, learned counsel for the petitioner and Mr.R.Neelakandan, learned Additional Advocate General assisted by Mr.G.Velu, learned Additional Government Pleader.
3. The case of the petitioners is that their brother Ram Prabhakar died as a bachelor on 05.06.2023, and at the time of his demise, he was living in his apartment at Paleripattu,, Avadi Taluk, Thiruvallur District. The petitioners are the legal heirs of the deceased. Hence, they have applied for a legal heirship certificate on 29.08.2023. The said application was rejected based on the report of the Village Administrative Officer stating that the petitioners are living in Ambattur Taluk and No Objection Certificate was not produced.
4. If the petitioners want to get the legal heirship certificate without any hassle, they can get the No Objection Certificate from the respondent and they
can produce the same before the Tahsildar within the jurisdiction where they are residing. The concerned jurisdictional Tahsildar can thereafter issue the legal heirship certificate since both the petitioners claim to be Class 2 legal heirs of the deceased.
5. In view of the above, there shall be a direction to the respondent to issue a No Objection Certificate to the petitioners within a period of four weeks from the date of receipt of a copy of this order. On receipt of the same, it is left open to the petitioners to submit the application before the jurisdictional Tahsildar where they are residing and get the legal heirship certificate in their name.
