ORDER : The Court Made the following order :- Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor. CD file is also perused.
2. Based on the complaint given by the father of the victim girl, girl missing complaint was registered on 24.11.2021. The F.I.R. specifically disclosed the name of this petitioner as a person who have enticed and kidnapped the victim girl and thereafter, the victim girl was rescued and the girl missing complaint was altered into Sections 417 and 376 of IPC and 164 statement of the victim girl is also recorded. On perusal of her 164 statement, it indicates that the petitioner has threatened the victim girl and took her to various places including Munar and kept her under illegal confinement and committed aggravated penetrative sexual assault. Further, the investigation also reveals that the petitioner herein is also a married person, who has involved in the above said crime. https://hcservices.ecourts.gov.in/hcservices/
3.The learned counsel for the petitioner would submit that the petitioner has also initiated divorce proceedings against his wife and only with the consent of the victim girl, they eloped. However, 164 statement of the victim girl states that something otherwise and in view of the fact that the investigation is almost completed and if the petitioner is released at this juncture, there is every possibility of abscondence. Hence, this Criminal Original Petition for bail is dismissed.
