No. A3/ 12111/ 2018 dated 30.7.2018 whereby confirming the 3rd respondent's proceedings S.M.A. No.A13/ 11081/ 2017 dated 24.8.2017 concurred with the 1st respondent's order of dismissal dated 06.04.2017 in proceedings S.M.A. No.A3/4858/2016 and quash the same as illegal. O R D E R

The learned counsel for the writ petitioner would submit that though the instant writ petition has been filed challenging the dismissal order, after the demise of the petitioner, he was not in a position to get the details of the legal heirs. He would further submit that in spite of his best efforts, he is not in a position to implead the legal heirs of the petitioner and hence, he was not in a position to represent on the previous hearings i.e., on 02.06.2023 and 16.06.2023.

2. In view of the submission made by the learned counsel for the 2/4

petitioner, there is no purpose in keeping this writ petition pending without any progress.

3. In the result, this writ petition is dismissed as abated. No costs. Consequently, connected WMP is also closed.
