ORDER
The petitioner, who was arrested and remanded to judicial custody on 20.01.2026 for the offences punishable under Sections 87 BNS 2023, Sections 5(1), 5(j)(ii) r/w 6(1) of POCSO Act, 2012 in Crime No.1 of 2026, registered on the file of the respondent police, seeks bail.
2.The allegation against the petitioner is that the petitioner is aged about 29 years and he developed a contact with the victim girl aged about 13 years and kidnapped her to lonely place and committed aggravated penetrative sexual assault, due to which, she became pregnant. Hence, the case has been registered. 3.The learned counsel for the petitioner submitted that the petitioner has not committed any offence as alleged and that a false case has been foisted against him. He further submitted that the petitioner was arrested by the respondent on 20.01.2026 and he is in judicial custody more than twenty five days and the petitioner is also ready to abide by any other stringent conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and reported that the victim girl is aged about 13 years and the statements were also recorded from her and the investigation in this case is pending. He further submitted that the victim girl is also secured and now she is under care and custody of her parents. Hence, he opposed for the grant of bail to the petitioner.
5. Considering the case of the prosecution that the petitioner is aged about 29 years and he kidnapped the minor victim girl aged about 13 years and
committed aggravated penetrative sexual assault and also caused pregnancy to her, I am not inclined to grant bail to the petitioner. 6.Accordingly, this Criminal Original Petition is dismissed. 16-02-2026 GBI To 1.The State Rep. by Sub- Inspector of Police, AWPS, Vazhappadi Police Station, Vazhappadi, Salem District.
