By an Order dated 27.02.2020, there was a direction to the III Additional District Judge, Salem, to dispose of the interim application within a period of two weeks. However, due to the pandemic situation, the interim application could not be taken up.
2. Mr.Jagadeesan, learned counsel for the petitioner would contend that both the parties have filed a joint memo before the trial Court to refer the matter to the Mediation.
3. The learned counsel for the respondent in the main C.R.P would state that the case is of the year 2004.
4. In reply, the learned counsel for the petitioner would submit that as against the Exparte decree, I.A. was filed and the matter has taken up to the Hon'ble Supreme Court and thereafter, the matter is returned back. Considering the checkered history of the case, the delay is due to the conduct of the parties and not due to the Judicial proceedings. Hence, the https://www.mhc.tn.gov.in/judis/
C.R.P.PD.No.875 of 2020 RMT.TEEKAA RAMAN, J kmm request of the III Additional District Judge, Salem, seeking extension of time is reasonable. Since the parties have approached the said Court and filed a joint memo to refer the matter for mediation, the matter is referred to the Mediation Centre, Salem. The Mediation process shall be completed within a period of two months from today failing which, the learned trial Judge shall take up the matter and dispose of the same within a period of two months thereafter.
