ORDER
This writ petition has been filed to restrain the respondents from considering any request for patta transfer in respect of the property, morefully described in the affidavit filed in support of this writ petition, within a time frame to be fixed by this Court.
2.According to the petitioner, the property, morefully disclosed in the affidavit filed in support of this writ petition, is owned by the petitioner. According to the petitioner, a third party, by name Sambasivam is attempting to get patta for the property transferred in his name from the official respondents. 3.Mr.D.Ravichander, learned Special Government Pleader accepts notice on behalf of the respondents.
4.The petitioner has filed supporting documents along with this writ petition to establish his case that he is the rightful owner of the property and that one Sambasivam has got no right over it.
5.This Court is not expressing any opinion on the merits of the supporting documents filed by the petitioner. Since the petitioner claims to be the owner of the property, necessarily, the objections of the petitioner before transferring the
patta in favour of Sambasivam or any other third party have to be considered by the second respondent and only thereafter, a decision can be taken as to whether patta can be transferred or not.
6.No prejudice would be caused to any other parties if the petitioner's objections, which have been raised in this writ petition are considered by the second respondent while considering any application seeking for transfer of patta for the property, morefully disclosed in the affidavit filed in support of this writ petition.
7.For the foregoing reasons, this writ petition is disposed of by directing the petitioner to submit his written objections to the second respondent within a period of one week from the date of receipt of a copy of this order. On receipt of the written objections, the second respondent is directed to consider the same that have been raised in this writ petition in case Mr.Sambasivam or any other party seeks for transfer of patta for the property in his name and only thereafter, pass final orders on the said patta transfer application. Consequently, connected WMP is closed. No costs.
