Prayer:- Civil Revision Petition filed under Article 227 of Constitution of India to dispose off the petition to appoint advocate commissioner in I.A.No.634 / 2014 in O.S.No.7 of 2012 on the file of the District Munsif Tirupur, within a stipulated time.

The Civil Revision Petition is taken up for final disposal at the admission stage itself.

The petitioner has filed an application in IA.No.634/2014 under Order 26 Rule 9 C.P.C in O.S.No.7/2012. When the matter was taken up on 04.08.2014, the respondents sought time to file the counter affidavit and the counter was filed as early as on 04.08.2015 and thereafter, the matter seems to be posted for enquiry and clarification. Even though, three years had lapsed, no progress is made and the application for Appointment of Advocate Commissioner has left undecided by the Lower Court. Aggrieved over the nondisposal of the Interlocutory Application, the petitioner/plaintiff has preferred the revision petition before this Court.

Considering the facts and circumstances of the case, in particular, the long pendency of the Interlocutory Application to appoint Advocate Commissioner in I.A.No.634/2014 in O.S.No.7/2012, a direction is issued to the learned District Munsif, Tiruppur to dispose of the same within a period of two months from the date of receipt of this order.
