The civil miscellaneous petition is filed to condone the delay of 323 days in filing the civil miscellaneous appeal against the order passed by the Motor Accidents Claims Tribunal in M.C.O.P.No.911 of 2016 dated 23.11.2017.

This matter was listed for hearing on 05.03.2020, none appeared for the petitioner/appellant. Thus, the case was directed to be listed under the caption 'For Dismissal' on 09.03.2020. When the case is taken up for hearing today, no one appeared on behalf of the appellant. In spite of the opportunity given, the appellant is not interested in pursuing this matter. 3.

Accordingly, the Civil Miscellaneous Petition stands dismissed and the Civil Miscellaneous Appeal is rejected at the SR Stage itself. No costs.
